The Essentials

What is the E-2 Visa,
who qualifies, and how to get it?

The E-2 nonimmigrant classification permits citizens of a country with which the United States maintains a qualifying treaty of commerce to enter the U.S. when investing a substantial amount of capital in a bona fide enterprise.

Treaty investor visas are renewable indefinitely as long as the underlying business remains operational and the applicant continues to direct and develop it. Spouses and children under 21 may accompany the principal applicant.

The E-2 is not a path to a green card on its own, but it can be a powerful long-term U.S. presence for the right founder.

Why founders choose E-2

Benefits of the E-2 Visa

  • Live and work in the U.S. while running your own business
  • Renewable indefinitely with no maximum stay
  • Spouse may apply for unrestricted work authorisation (EAD)
  • Children under 21 can join as derivative dependants
  • No set minimum investment under federal regulation
  • May own 100% of the U.S. enterprise

A note from the firm

If you’ve read this far, your case is probably worth a conversation.

Three ways to begin. Pick whichever fits your week. A partner reviews every new file personally, so the first reply you get is from an attorney, not an assistant.
